SECTION 1 — ACCEPTANCE OF TERMS

By placing an order, you represent and warrant under penalty of law that you meet all eligibility requirements. GMS TACTICAL LLC will not be held liable for any misrepresentation made by the customer.

GMS TACTICAL LLC makes no warranties, expressed or implied, regarding the completeness, accuracy, or fitness for any particular purpose of the information on this site. Product descriptions, specifications, and images are provided as-is. Minor variations from displayed images may occur. We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice, even after an order has been submitted.

SECTION 4 — PRICING & PAYMENT

All prices are stated in U.S. Dollars and are subject to change without notice. GMS TACTICAL LLC reserves the right to refuse, cancel, or limit any order at its sole discretion — including orders that appear fraudulent, abusive, or placed by resellers operating without prior written authorization. Payment must be received in full and cleared before any order is processed or shipped. Chargebacks filed without first exhausting our dispute resolution process will be contested aggressively and may result in permanent account termination and referral to collections.

SECTION 5 — PROHIBITED USES

You are expressly prohibited from using this site to:

(a) violate any federal, state, or local law or regulation; (b) transmit unauthorized commercial communications; (c) harvest or scrape data without written consent; (d) impersonate GMS TACTICAL LLC or its personnel; (e) engage in any activity that disrupts, damages, or interferes with our operations; (f) attempt to circumvent security measures; or (g) export products in violation of U.S. export control laws.

SECTION 9 — GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively by binding arbitration administered in Shawnee County, Kansas, under the rules of the American Arbitration Association.

WARNING

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS-ACTION LITIGATION. The prevailing party shall be entitled to recover reasonable attorneys' fees.

SECTION 10 — SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is found unenforceable, it shall be severed and the remaining provisions shall remain in full force.
